RE: EXTRADITION OF AUSTRALIANS TO NON-RECIPROCAL COUNTRIES

It is with great concern for the civil rights of our fellow Australian Countrymen that we write to you as our Prime Minister, for you to clarify the Government’s Policy in relation to the Extradition of Australians to non-reciprocal 3rd nations. Our great country has many bi-lateral extradition arrangements with many countries, but most are on a Treaty basis of Mutual Recognition and Reciprocity of Extradition Requests.
We ask you: Does your Government support and condone the extradition of Australian Citizens to Countries that are not able to extradite their citizens to Australia upon a request from Australia, that is one-way extraditions?
It has become apparent there is an aberration in the policy of Mutual Extradition and Reciprocity, this being under the Extradition Act and one of its Regulations. The interplay of the Extradition Act and the Extradition (Croatia) Regulation can result in Extradition Requests from Croatia being accepted in Australia, when the opposite Requests from Australia to Croatia cannot be accepted by Croatia as its Constitution prohibits the extradition of its citizens.
This Regulation should be immediately withdrawn and removed as an affront to the rights of Australian Citizens to be protected by their Government and Country.
We again ask you: Does your Government support and condone the extradition of Australian Citizens to Countries that are not able to extradite their citizens to Australia upon a request from Australia, that is one-way extraditions?
