TO THE HON BRENDAN O’CONNOR MP


INTERIM SUBMISSIONS on EXTRADITION REQUEST for DANIEL SNEDDEN (aka DRAGAN VASILJKOVIC)


We refer to recent developments in relation to Daniel Snedden and our previous correspondence with you.

 

We write to you as the Minister responsible and urge you not to make a hasty determination in relation to the Extradition Request by Croatia for Mr Snedden, or sign any documents, until you are fully appraised from all relevant and interested parties, and until we have an opportunity to submit further Submissions to you.

 

Mr Snedden currently has a legal procedure on foot pending in the NSW Court of Appeal, and now that he has returned he is able to give proper instructions to his legal representatives to pursue that appeal. Any extradition of Mr Snedden to an overseas country could mean that his rights to appeal may be lost, and this would adversely affect his civil and human rights as an Australian citizen to be heard in a Court in Australia on a matter of vital concern to him.

 

We understand that the Appeal is in process and we believe that there are strong and cogent reasons for the Appeal to succeed. In that case Mr Snedden may be put to a retrial, and if extradited he would be away from Australia and this could be a denial of natural justice.

 

We also refer you to our recent letter to you querying the public policy aberration in relation to one-way extraditions to countries (such as Croatia) that do not recognise the public policy principles of Mutuality and Reciprocity. We attach a copy of similar letter to the Honorable Prime Minister Mr Rudd. We have written to all the members of the House , as well as all the Senators of the Parliament and asked them the same question. Not one has replied that they support this public policy aberration of one-way extraditions.

 

Minister, we urge that neither should you support the public policy aberration that underlies the Extradition Croatia Regulation 2004. We ask and urge you to write to the Attorney General for him to exercise his discretion and seriously consider the repeal of this Regulation.

 

Ordinary Australians are concerned that any Australians, including our soldiers, could find themselves subject to these types of proceedings.

 

We ask and request that you not exercise your discretion at this time but rather wait until you are fully appraised of all the issues and the receipt of further Submissions from us.
